Welcome to HomeEaz ("Site"). These Terms & Conditions ("Terms") govern your access to and use of our Site and the purchase of products from us. By accessing or using the Site and/or placing an order you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site.

All purchases made through this Site are purchases from Basinha, and we are solely responsible for fulfilling orders, product quality, returns, refunds and any claims from end customers unless expressly stated otherwise.

•       Buyer / You: Any person who visits the Site or places an order with Us.

•       Products: Goods displayed for sale on the Site.

1.     All orders placed through the Site are subject to acceptance by Us. We reserve the right to refuse or cancel any order for any reason, including product or pricing errors, limited stock, or suspected fraud.

2.     After you place an order, you will receive an order confirmation message via WhatsApp and, if provided, via email. This confirmation does not mean the order has been accepted — it only confirms we have received your order. We will notify you when your order has been accepted and is being processed.

3.     Any estimated delivery or processing times are estimates only and not guaranteed. See Shipping & Delivery below for tentative timelines.

4.     Prices displayed on the Site are in Indian Rupees (INR) and include applicable taxes unless stated otherwise. Shipping, handling, and other fees (if any) will be shown during checkout.

5.     We reserve the right to change prices at any time without prior notice. If a price is entered incorrectly on the Site, we may refuse or cancel any orders placed for the product listed at the incorrect price.

6.     Payment must be made by the methods displayed on the Site. You authorize Us (and our payment service providers) to collect payment using the information you provide.

7.     In case of multiple non-acceptance of an order by you, payment would be refunded, excluding shipping and handling charges (if any), and no more deliveries of that order would be attempted. We reserve the right to decide what the attempted number of deliveries would be before we decide not to attempt anymore.

8.     Estimated delivery: 7–10 business days from shipment; though in some cases, delivery may take up to 21 business days. Delivery times are estimates only and may vary due to supplier, carrier, customs, or other factors beyond our control. Where possible we will display estimated delivery windows on the product page.

9.     We will provide tracking information where available. Delivery dates are estimates only; we are not liable for delays caused by carriers, weather, force majeure, or any other unavoidable circumstances.

10.  Upon receipt of full payment and delivery of the Product, responsibility for the Product shall be transferred to the purchaser, except as required under applicable law or any express warranty provided herein.

11.  We shall not be liable for any loss, damage, or deterioration of the Products occurring during transit, nor for any failure or delay in delivery of the Products.

12.  Returns: For most consumer products, returns for damaged, defective items must be reported to us within 48 hours of delivery, unless a different window is stated on the product page. To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

13. Cancellations: Orders are eligible for cancellation only within 24 hours of order placement. Orders that fall outside this window are not eligible for cancellation and may only be addressed through our standard return process upon receiving them.

14. Refunds: Refunds for returned items made in accordance with will be processed after we receive and inspect the returned item. Processing times may vary. All refunds will be issued to your original payment method.
If an item is confirmed lost or destroyed in transit, we will initiate your refund once we receive confirmation of this, without waiting to receive the item itself.
If an order is cancelled in accordance with Section 13 and payment has already been made, we will immediately initiate your refund to your original payment method.
Outbound shipping charges are non-refundable, unless the return is due to a damaged or defective item, or a mis-shipment on our part. This exception does not apply to failed delivery attempts, for which the buyer is solely responsible.

 

15.  We attempt to be as accurate as possible in product descriptions, images, sizes and specifications. However, we do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current, or error-free.

16.  Product images may be enhanced for advertising purposes. The actual product you receive may differ from images shown on the Site.

You must not use the Site to purchase or attempt to purchase goods that are prohibited by applicable law or by supplier restrictions. Prohibited items include (but are not limited to): adult pornography or illegal sexual content, weapons and restricted knives, illegal drugs and paraphernalia, counterfeit goods, human remains, endangered wildlife parts, certain medical and prescription drugs, explosives, radioactive materials, and any other items prohibited by applicable law or by our suppliers. If an order for a prohibited item is placed, we will cancel the order and notify you.

All content on the Site (text, graphics, logos, images, product listings, software) is owned or licensed by Us. You may not reproduce, distribute, modify, create derivative works of, publicly display or exploit any part of the Site without our prior written consent.

Our collection and use of personal data is governed by our Privacy Policy. By using the Site, you consent to the processing described in the Privacy Policy.

17.  Products are provided "as is" and "as available". Except as expressly stated herein or required by law, we deny all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

18.  To the maximum extent permitted by law, Basinha, its officers, directors, employees, agents, suppliers and affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, or business opportunity arising from or relating to your purchase or use of Products, even if we have been advised of the possibility of such damages.

19.  Our aggregate liability for any claim arising out of or relating to these Terms or your purchase shall not exceed the price paid by you for the Product that gives rise to the claim (or INR 5,000 if the law requires a higher minimum limit).

You agree to indemnify, defend, and hold harmless Basinha, their respective officers, directors, employees and agents from and against any claims, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of law, or your infringement of third-party rights.

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labour disputes, government actions, supply-chain disruptions, outages, or other emergencies.

We may update these Terms from time to time. We are not obliged to inform you of such changes. Continued use of the Site after changes constitutes acceptance of the revised Terms.

Nothing in these Terms is intended to limit your statutory rights under applicable consumer protection laws.
